Unaccompanied Children Can Now File Asylum Applications With Uscis And Not Through An Immigration Judge In A Removal Proceeding

The U.S. Citizenship and Immigration Services (USCIS) recently announced it is now responsible for initial adjudication of applications for asylum from “Unaccompanied Alien Children” (UAC) under the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (TVPRA). An Unaccompanied Alien Child is an immigration law terminology referring to a child who was not accompanied by a parent or legal guardian that entered the U.S. without inspection or does not has lawful immigration status in the U.S., and the child is under the age of 18. As such, unaccompanied children can now file asylum application with USCIS and do not have to go through the adversarial process of in removal proceedings Some of these children previously would have been required to file for asylum in immigration court with the Executive Office for Immigration Review in the Department of Justice.
The new asylum application procedure for UAC was created by the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (TVPRA). Under one of the provisions of the TVPRA, these unaccompanied children, who have been issued a Notice to Appear (NTA) in immigration courts, will now file their initial application for asylum with USCIS with their local district office. The TVPRA also provides an opportunity for unaccompanied children, who did not previously file for asylum with USCIS and, who either have a pending claim in immigration court, on appeal to the Board of Immigration Appeals (BIA), or in U.S. Federal Court of Appeals, to have their asylum claim heard and adjudicated by a USCIS asylum officer in a non-adversarial environment (out of court proceeding and without a government attorney by the Department of Homeland Security, DHS).
